SWEEPSTAKES PERIOD: The Johnsonville Super Hole III Sausage for a Year Sweepstakes (“Sweepstakes”) begins at 8:00 am CDT on July 20, 2022 and ends at 11:59 pm CDT on August 7, 2022 (“Sweepstakes Period”). Johnsonville’s computer is the official timekeeping device for the sweepstakes.

SPONSOR: Johnsonville, LLC, N6928 Johnsonville Way, Sheboygan Falls, WI 53085 (“Johnsonville”).

AGREEMENT TO THE OFFICIAL RULES: By participating in the Sweepstakes, all entrants fully and unconditionally agree to and accept these Official Rules and Johnsonville’s decisions which are final and binding in all matters related to the Sweepstakes. Winning the prizes (described below) is contingent upon fulfilling all requirements set forth herein.

ELIGIBILITY. The Sweepstakes is open only to legal residents of the 50 United States or District of Columbia who, at the time of entry, are 18 years or older and are not current members of the Johnsonville Enthusiast’s Club. Employees, directors and officers and their immediate families (husbands, wives, brothers, sisters, parents and children and their spouses) and household members (whether or not related) of Johnsonville, and each of their respective parents, subsidiaries and affiliates, and companies involved in the implementation and execution of the Sweepstakes or otherwise associated with the Sweepstakes (collectively the “Sweepstakes Entities”) are not eligible.

HOW TO ENTER: Entrants must complete the form to join the “Johnsonville Enthusiast’s Club” at the link contained in the QR Code in Johnsonville’s “Super Hole III” ads running from July 20, 2022 through August 7, 2022. All entries become the property of the Johnsonville and will not be acknowledged or returned. Johnsonville assumes no responsibility for lost, mutilated, late or misdirected entries. Limit 1 entry per person.

TIMING OF DRAWINGS AND NOTIFICATION TO WINNERS. The winner of the prize will be selected at a random drawing on or about August 8, 2022. The winner will be notified by Johnsonville by electronic mail at the address listed in the winning entrant’s entry. If a winner cannot be contacted or fails to confirm his or her eligibility and shipping address within 2 days of notification, an alternate winner may be selected by Johnsonville from all remaining eligible entries in a second-chance QB\74865047.2 drawing. Selection of winners will be conducted by Johnsonville, whose decisions are final.

PRIZES AND THE VALUE OF THE PRIZES. One Grand Prize: Grand Prize Winner will receive a one-year’s supply of Johnsonville Sausages, provided in the form of 12 coupons, each valued at $7.00. The approximate retail value (ARV) of the prize is $84.00. Any difference between the stated ARV and the actual value, if any, will not be awarded. GENERAL PRIZE RESTRICTIONS. The prize is subject to availability and is subject to change. The prize may not be transferred, assigned, changed or redeemed for cash, except at the sole discretion of Johnsonville. Johnsonville reserves the right to substitute the prize in whole or in part with other prizes of comparable or greater value if the intended prize is not available for any reason as determined by Johnsonville in its sole discretion.

ODDS OF WINNING. Odds of winning will depend upon the number of eligible entries received.

GENERAL CONDITIONS AND RELEASE. By participating, each entrant (a) agrees to release Johnsonville, Sweepstakes Entities, and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives from any and all liability for any claims, costs, injuries, losses or damages of any kind that may occur, directly or indirectly, in whole or in part, by their participation in this Sweepstakes, including the unauthorized or illegal access to personally identifiable or sensitive information or the acceptance, possession, use, or misuse of the prize except where prohibited by law; (b) consents to the use by Johnsonville and each of their respective designees of the winner’s name, hometown, photograph, voice, or other likenesses and prize information for promotion, advertising and marketing purposes in any media now known or hereafter devised, throughout the world, in perpetuity, without additional compensation or consideration, notification or permission, unless prohibited by law, and upon request will provide written confirmation of such consent; and (c) acknowledges that none of the Sweepstakes Entities or anyone else has either made, or is in any manner responsible or liable for, any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to any prize including, but not limited to, its quality or availability. Neither any of the Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human or other error, technical malfunctions, lost or delayed data or voice transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website or to complete a telephone call or facsimile transaction, or any other error or malfunction, or late, lost or misdirected mail, or any injury or damage to an entrant’s or any other person’s computer related to or resulting from participation in this Sweepstakes.

CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DAMAGE ANY WEBSITE, TAMPER WITH THE ENTRY PROCESS, OR OTHERWISE UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, JOHNSONVILLE WILL DISQUALIFY ANY SUCH ENTRANT, AND JOHNSONVILLE AND THE APPLICABLE ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEY FEES) FROM ANY SUCH ENTRANT OR INDIVIDUAL(S) TO THE FULLEST EXTENT PERMITTED BY LAW. No failure to enforce any term of these Official Rules shall constitute a waiver of that provision. If for any reason the Sweepstakes (or any portion thereof) is not capable of being executed as planned, or in the case of infection by computer virus, bugs, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other causes that in the opinion of Johnsonville, corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes (or any portion thereof), Johnsonville reserves the right in their sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes (or any portion thereof). Entries not complying with all rules are subject to disqualification. DISPUTE RESOLUTION: Except where prohibited, by participating, Sweepstakes entrants agree that: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and Johnsonville and its agents shall be governed by and construed exclusively in accordance with the laws of the State of Wisconsin without giving effect to any principles of conflicts of law of any jurisdiction. Entrant agrees that any action at law or in equity arising out of or relating to this Sweepstakes, or awarding of the prizes, shall be filed only in the state or federal courts located in Wisconsin and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such action. Except where prohibited, by participating in this Sweepstakes, each entrant agrees that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes, or awarding of the prizes, shall be resolved individually, without resort to any form of class action; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys’ fees; and (c) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out- of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
